in 2023 November 10 in the morning, a traffic accident occurred in Rūdiškės, during which a minor (born in 2008), driving a BMW X5 and traveling at high speed on a side road, did not stop before the STOP sign, did not pass a VW Caravelle driving on the main road and collided with it.
A police officer (born in 1970) who was driving a VW Caravelle on vacation was killed in the accident, and a passenger (born in 1974) was injured.
The driver of the BMW X5 and three other underage passengers who were traveling together were also injured: one of them was born in 2008, the others in 2009.
After evaluating the data obtained during the investigation, the conclusions of the expert examinations, and the testimony of the witnesses, the prosecutor concluded that the accident was caused by the actions of the driver of the BMW X5 car and the violations of the requirements of the Road Traffic Rules: he was driving around 110 km/h in the settlement. at speed, in front of the intersection with the main road, near which the STOP sign is installed, he did not brake, he did not pass a car traveling on the main road and collided with it.

A pre-trial investigation was being conducted into the murder. After evaluating all the data collected in the case, the prosecutor concluded that the BMW X5 driver did not commit the act with indirect intent, but due to carelessness (criminal trust).
At a young age and not sufficiently socially mature, with absolutely no ability to drive a vehicle, the minor overestimated his driving abilities, acting lightly, not expecting that his risky behavior could cause such extremely painful consequences. He drove the car sober, no traces of alcohol or drugs were found in his body.
An act committed by a minor driver must be qualified as a violation of road traffic safety or vehicle operation rules, if it resulted in a traffic accident in which a person died. Taking into account the fact that, according to the provisions of the Criminal Code, criminal liability for this criminal act can be applied to a person who has reached the age of 16 at the time of the crime, and the boy who drove the BMW X5 car was 15 years old at the time, the pre-trial investigation must be terminated.
The prosecutor’s decision to terminate the pre-trial investigation can be appealed to a higher prosecutor.
