A resounding “slap” to the management of ERT and to Konstantinos Zoulas is constituted by the decision of the Single-Member Court of First Instance, as it fully vindicates the journalist Eva Boura for the cancellation of her show, emphasizing that it constitutes “a premeditated” and “vindictive” behavior.
According to typologies.gr, the court calls on ERT to rehabilitate the journalist in a political show commensurate with her qualifications and her many years of experience in European issues and awards compensation for moral damages.
Specifically, the Single-Member Court of First Instance of Athens with decision 564/2024 against the management of ERT, based on strong case law (adhoc decisions of the Supreme Court), facts, witness testimonies, and the submission of evidence with the additional intervention of ESIEA, ruled that the show “Europe” was wrongly halted and journalist Eva Boura was unjustly removed from her position.
As highlighted in the publication, the decision states that the behavior of ERT’s management was “premeditated and vindictive, due to her candidacy with KINAL in the 2019 elections” as well as its reaction to the cancellation of the show, which provoked a protest announcement from ESIEA as well as widespread reactions.
The incident occurred in 2020 with the intention of changing the name and composition of the show, so that it could be assigned to a private company for a joint production with ERT.
With the court’s decision, the management of ERT and the general director of news Fotis Kafarakis, who as stated “cut” the show, are called to rehabilitate the journalist in a political show commensurate with her qualifications and her many years of experience in European issues, and is awarded compensation for moral damages, imposing even the legal costs on ERT due to the additional intervention of ESIEA.
According to the same publication, the reasoning of the decision assesses the exercise of ERT’s managerial right as abusive, since within the framework of business freedom and its public role, as provided by the Constitution and its founding law, it did not act with the well-understood business interest in mind and failed to utilize its journalists in the most beneficial way.
