This joint circular is addressed to Ladies and Gentlemen Walis and Governors, Presidents of Municipal Councils, Directors of Urban Agencies, as well as Regional Inspectors of Urban Planning, Architecture and Land Development, with a view to encouraging them to take a set of measures aimed at simplifying the procedures for issuing permits concerning construction in rural areas, indicates a press release from the Ministry of National Land Development, Urban Planning, Housing and Urban Policy.
The joint circular is therefore part of the efforts made by the Ministry of National Land Use Planning, Urban Planning, Housing and Urban Policy and its partners aimed at supervising construction in rural areas by generalizing the coverage of rural areas in urban planning documents and overcoming the constraints linked to their absence, as well as the establishment of a program for free architectural and technical assistance for rural areas, while taking into account their local specificities and this in order to improve the living environment of citizens.
However, and despite these efforts, the granting of building permits in rural areas raises several constraints and difficulties relating to the minimum surface area of the plot on which the project is envisaged, the buildable ground area, the construction height and other technical and land constraints.
This joint circular comes in this context to encourage the application of its provisions allowing the simplification of the construction procedure in rural areas, through several measures, in particular:
– The delimitation of the perimeters of douars not covered by urban planning documents by a provincial committee established by the Walis and Governors, under their supervision, in order to unify the procedures for processing applications for obtaining building permits in rural areas, and to allow the population of these douars the possibility of having said permits even in cases of projects that do not meet the required condition of one hectare, as long as the planned construction does not promote dispersed urbanization, and that it preserves the potential and natural resources, while guaranteeing their sustainability, and this according to a procedure annexed to the joint circular;
– The implementation of the provisions relating to the holding of the specialized commission provided for by Article 35 of Decree No. 2.92.832 in application of Law No. 12.90 and its systematic meeting at the request of the president of the municipality or the Governor, as the case may be, with a view to deciding on applications for construction projects that do not meet the required conditions relating to the minimum surface area of the land to be built on, the surface area permitted for construction and the construction height, provided that the planned construction does not encourage dispersed urbanization;
– The reduction of the constituent documents of applications for obtaining individual building permits and the request for only the necessary documents, in accordance with the provisions of Law No. 55.19 relating to the simplification of administrative procedures and formalities, and considering the fragile economic and social situation of the rural population;
– The greatest implementation of architectural and technical assistance in favor of the rural population, in particular that of the douars whose perimeters are already delimited.
It should be recalled, in fine, that the purpose of the building permit requirement in rural areas is to verify the conformity of the construction operation with the content of the town planning documents covering these areas, and compliance with the provisions of the legislative and regulatory texts in force, as well as to ensure the safety of the population by having all the necessary technical guarantees.
