He called, went to the salon – did not find anything: he had neither phone nor money.
“July 19 I ordered a Samsung S24+ from Telia online. I transferred 1036 euros. However, three days later I received a letter saying that I could not purchase phone insurance at the same time, even though the website indicated such an option. I immediately asked to cancel the order and return the money.
It was explained to me that the insurance service cannot be provided because I do not have active services with the mobile operator.
Unfortunately, I was not able to recover the transferred amount for almost four weeks”, – to the portal lrytas.lt Olivia said.
“My family and I were trying to figure out how to get money back from the company for the item it didn’t sell,” the interviewer quipped.
Coincidence or not, a thousand euros were deposited into the account after the portal inquired about the story lrytas.lt.
The representative of the mobile operator, Audrius Stasiulaitis, could only regret the human error of the employee. “This is a unique situation, usually the money for the paid equipment is returned within 10 working days”, he commented to the portal lrytas.lt.
The representative of the State Consumer Rights Protection Service, Dalia Malinauskienė, explained how a buyer should act when he finds himself in a similar situation.
When buying online, you have the right to cancel the sales contract and get your money back within 14 days, if the product is not a perishable product, has not been used and has not lost its appearance.
It is important for the user to inform the seller about the withdrawal from the contract and to return the product if it is received. The seller must return the money paid immediately, but no longer than within 14 days.
“Thus, in this case, it appears that the consumer opted out of the phone sales contract because he did not receive the desired additional service and properly informed the seller of the opt-out.” In this case, the seller was obliged to return the money as soon as possible, but not longer than 14 days.
If the consumer does not receive the money within this period, the seller does not respond, does not provide information, the consumer has the right to apply to the State Consumer Rights Protection Service for an out-of-court settlement of the dispute.
Together with the application to VVTAT, it is important to submit all available documents related to the order, correspondence with the seller, and other significant evidence,” said D. Malinauskienė.
