Constitutional Court nullifies rulings obtained by Wilman Terán in the Judiciary

The Court declared inadmissible the appeals filed by Wilman Terán for more budget when he was the president of the Judiciary. In addition, it ordered disciplinary proceedings against three judges.

The Constitutional Court has overturned the rulings in favor of the protective action with which Wilman Terán sought to have the Ministry of Finance allocate USD 265.6 million to the Judicial Council when he was president.

The ruling issued by Judge Enrique Herrería states that the protection action is to protect constitutional rights, and that the activated guarantee should not have been used to alter the General State Budget, seeking to reduce public funds in favor of the Judiciary.

The Court considered that these rulings, which were issued in March 2023, constitute a direct interference in the exclusive powers of other branches of the State. It therefore decided to annul them, as they affect the right to legal certainty.

The magistrate declared that the judges of the Criminal Chamber of the Court of Justice of Pichincha made an inexcusable error. For this reason, he ordered the Judicial Council to open the disciplinary process against José Jiménez, Mónica Bravo and Miguel Ángel Narváez, reported Ecuavisa.

The extraordinary action of unconstitutionality was filed by the Ministry of Finance in October of last year, after the Pichincha Court partially accepted Terán’s appeal and ordered the Government of Guillermo Lasso to make the payment within 15 days.

A judge had previously ordered a technical meeting to be held to determine priority projects. The Court also revoked the ruling.
