The court did not respect the requests made by the prosecution to take the most severe measure of procedural coercion “detention” in relation to a father and son, respectively 50 years old and 26 years old. On August 30 of this year, charges were brought against them for causing of minor bodily injury due to hooliganism of a man, in complicity with other unidentified persons. The act was committed in the dark part of the day on August 11 this year in the area of the “Black Sea” stadium, when a conflict arose between supporters of the two fan clubs opposing football teams. The legal punishment for such an act is up to 3 years of imprisonment.
The court noted that the act was not gravely intentional. From the evidence in the case and the testimony of the numerous witnesses examined so far, it cannot reasonably be assumed that the accused, even if they had participated in the act for which they were charged, were in danger of continuing to commit a crime or of thwarting the investigation by influencing on witnesses to reveal the objective truth. The court rejected the prosecution’s request to impose the most severe measure of procedural coercion, “detention in custody”, and in view of the gravity of the accusation and the financial situation of the accused, it determined measures of remand, “cash guarantee”, in the amount of BGN 1,000 for each of them, payable within three days.
The rulings of the Regional Court – Varna on the non-abortion measures can be appealed to the appellate authority within 3 days, and in the event of a complaint or protest, the cases are scheduled for consideration before the Supreme Court on September 11 at 1 p.m.
