According to the Attorney General’s Office, several legal representatives of State Social Enterprises (ESE) and some judges of the Republic are ordering embargoes on public resources of social security in health, which by law are not subject to seizure, except for exceptions established by the Constitutional Court.
These actions contravene legal provisions and put essential health care resources at risk.
The control body has transferred these cases to the Attorney General’s Office, the National Commission of Judicial Discipline and the disciplinary operator, so that the irregular actions are investigated. Among the ESE Involved in these processes are:

The most worrying thing is that, according to the Attorney General’s Office, there is a cartel of lawyers who would be advising the legal representatives. of these institutions, receiving up to 30% of the illegally collected resources. These funds, which are exclusively intended for health, are allegedly being appropriated through administrative coercive collection processes that the ESE do not have the legal capacity to carry out.
Although in March 2023, the Public Ministry issued Circular 002, recalling the legal restrictions for seizing social security resourcessome judges and hospital directors have ignored these provisions. According to the complaints, they have even pressured banks with threats of legal proceedings and criminal charges, seeking to enforce the illegal embargo measures.
The Attorney General’s Office has also informed the Financial Superintendence of these undue pressures on banking entities, in order to take preventive measures and avoid the execution of these irregular orders. It also warned of the serious consequences that the diversion of health resources could have, affecting the provision of essential services in hospitals and health centers that depend on these funds for their operation.
