The defense of the general director of Carabineros, Ricardo Yáñez, resorted to this resource to try to reschedule the formalization set for October 1.

The lawyers of the general director of Carabineros, Ricardo Yáñez, filed an appeal in court with which they seek to postpone its formalization due to the crime of omission of illegitimate pressures, within the framework of the social outbreak of 2019.

For that purpose, The defense of the highest authority of the police institution filed an appeal for protection before the Court of Appeals of Santiagothrough which it is requested to reschedule the hearing, set for next October 1.

This took place on Wednesday night, and with it they seek to assign a new date for the formalization, “within a prudent period, in order to safeguard the personal freedom of the protected person“.

Why General Yáñez seeks to postpone its formalization

The appeal for protection presented by Ricardo Yáñez’s defense was presented after the Fourth Guarantee Court of Santiago rejected the request to postpone the formalization hearing because General Yáñez’s lawyer, Jorge Martínez Reveco, is very ill. For this reason, they argue that their new defenders would not have time to prepare adequately.

In this context, the lawyers of the general director of Carabineros stated that “the crimes that are charged and for which the protected party is intended to be formalized on October 1, 2024, are all crimes that have the penalty of crime, so the defense delegate, due to the illness of the trusted defender, must have all the background information and also the time necessary to prepare the defense so that it is allowed to discuss the facts for which the protected person will be formalized and the personal precautionary measures“.

The Government has reiterated on multiple occasions that once the general director of the Carabineros is formalized, must step down as chief of uniformed police.
