The Libyan People’s Voice Party condemned the attempts made by the Speaker of the House of Representatives, Aguila Saleh, to interfere in judicial affairs, which were clear in the procedures he took in violation of the Constitution under which the Supreme Court came.
This came in a statement, a copy of which was obtained by Ain Libya, regarding the statement issued by the Supreme Court in response to the House of Representatives’ decision to establish the Supreme Constitutional Court.
The party noted that attempts to interfere in judicial affairs mean an attempt to destroy the rule that says that separation of powers and non-interference of one with the other is one of the foundations on which democratic countries are built.
The statement indicated that the attempts made by the House of Representatives to interfere in judicial affairs aim to dominate and contain the judicial authority.
The People’s Voice Party also pointed out that the deliberate attempts to waste judicial rulings and not to take them into consideration by the legislative authority represented by the House of Representatives undermines confidence in the judiciary and is a flagrant violation of constitutional legitimacy.
The party concluded by affirming in detail what was stated in the statement of the General Assembly of the Supreme Court.
The Supreme Court responded to the House of Representatives regarding the establishment of the Supreme Constitutional Court, the placement of its judges, and the opening of its headquarters in the city of Benghazi a few days ago. It criticized the ignoring of its rulings regarding the law establishing the new court, and the attempts to subjugate and contain the judicial authority by the legislative authority.
The General Assembly of the Supreme Court said in its statement: “The Supreme Court, as it begins its seventy-second judicial year, continues to perform its role in achieving justice and establishing the principles of law.”
The General Assembly alerted to the seriousness of the approach taken by the legislative authority towards the judicial authority by opening the building of what it called the Constitutional Court, and taking the legal oath to work in it, thus ignoring the rulings of the Supreme Court in the two constitutional appeals (4 and 5) of the year 70 BC.
The Supreme Court considered that the procedures of the House of Representatives constitute a violation of the principle of separation of powers, and a blatant violation of the established principles of law and constitutional jurisprudence, and the principle of judicial independence, the achievement of which and respect for its rulings is an essential pillar of any democratic system, noting that the failure to implement judicial rulings by any party or Authority in the state represents a serious violation of the principle of separation of powers, and stigmatizes the existing system of government as tyranny. At the same time, the judiciary loses the justification for its existence in the first place if it is not effective and its rulings are enforceable, as there is no value for a right that is not enforceable.
