According to the announcement, emissions from industrial facilities are now subject to the strictest rules within the European Union in Hungary as well. In order to further strengthen the health of the Hungarian people and the protection of the environment, the Ministry of Energy reviewed it and, taking into account the experience of the authorities and the comments of the public, it modified the emission limits of several particularly toxic air pollutants to the German level, which is stricter than the EU regulations, in the case of factories.
The new regulation – similar to the one in Germany – establishes the strictest limit values in the European Union for certain air pollutants, in particular the carcinogenic, mutagenic, harmful to the fetus (CMR) and nickel, cobalt, manganese (NCM) bound to dust in the air, which is particularly dangerous to health ) for materials. Thanks to the amendment, regardless of the type of activity, the environmental protection authorities can impose stricter limit values in the permits that are reduced by half or a fifth of the previous ones, they wrote.
The ministry submitted the amendments to the regulations on the limit values of the air pollution level and the emission limit values of stationary point sources of air pollution, as well as the limitation of the emission of volatile organic compounds from certain activities, for social consultation, and it also consulted with the National Environmental Protection Council and the Hungarian Chamber of Commerce and Industry.
As a result, the significantly stricter provisions must be applied in the case of new investments – i.e. those whose environmental licensing procedure has not yet started – from the entry into force of the legislation, and in the case of ongoing licenses from January 1, 2027. In the case of factories that are already operating, the new emission limit values, which are much stricter than before, must be applied from January 1, 2028. Changes to the related licenses must be initiated by the operators in all cases, it is explained in the announcement.
The amendment of the regulation further increases environmental protection expectations for investors, which serves to protect both our environment and the health of the Hungarian people. The government has a firm expectation for all investors to comply with the environmental protection, labor protection and other rules applicable to their activities. The authorities constantly check compliance with the rules, and if the operation of the industrial plants does not comply with the legal regulations or the license, the authority will take the appropriate steps, wrote the EM.
