New Delhi: Unhappy over the allegations leveled against the country’s former Chief Justice (CJI) Ranjan Gogoi, the Supreme Court on Tuesday rejected a petitioner’s plea and ordered the security personnel to take him out of the courtroom. Arun Ramchandra Hublikar filed a petition in the apex court against his illegal dismissal from service and sought an internal inquiry against former Chief Justice Gogoi for rejecting the petition filed in the past in the service dispute.

Justice showed the petitioner the way out

Angered by the allegations, a bench of Justices Bela M Trivedi and Satish Chandra Sharma ordered the security personnel to escort Hublikar out of the courtroom. A bench headed by Chief Justice DY Chandrachud had on September 30 taken strong objection to the petition seeking investigation against the former CJI and asked the petitioner to remove the judge’s name from the list of parties.

Court imposed fine

During the hearing on Tuesday, the bench got angry when the petitioner took the name of the former CJI. He said we are going to fine you. Do not take the name of any judge. There is no merit in your case. However, the petitioner objected and said how can you say that my case has no merit. How can this be said? This is injustice against me. At least I should get justice before I die.

On this the bench said that it rejects the petition, after which the security personnel were directed to take the petitioner out of the court room. In order to list the petition for hearing, a bench headed by Justice Chandrachud had put a condition before the petitioner to remove the name of the former CJI from the list of parties.

The bench had said that how can you file a petition making a judge a respondent? Some dignity should be maintained. You cannot just say that I want an internal inquiry against a judge. Justice Ranjan Gogoi was a former judge of the Supreme Court. He had said that Justice Gogoi had retired as the Chief Justice of India. You cannot say that I want an internal inquiry against a judge because you did not succeed in getting your arguments across his bench. Sorry, we can’t afford it.
