National Court judge Santiago Pedraz declared inadmissible the complaint filed by the PP against the PSOE for illicit financing in the context of the case in which he is investigating an organization allegedly dedicated to fraud in the payment of hydrocarbon taxes. Furthermore, he agreed to keep the businessman Víctor de A in prison without conditions.
The inadmissible complaint of the PP was directed, in addition to the PSOE, against the entrepreneurs Víctor de A., his partner Claudio R. and against Koldo G., former advisor to the former minister José Luis Ábalos, for alleged money laundering crimes, corruption, drug trafficking. illicit influences and financing.
In an order, in line with the report of the Anti-Corruption Prosecutor’s Office, Pedraz underlines that to accept the complaint it is necessary to analyze whether the data offered anonymously in the journalistic information invoked have sufficient virtuality to initiate legal action. investigation.
The investigating judge recalls that the anonymous complaint is fully valid for starting an investigation, provided that the information is supported by confirmatory data, or that it is the same that functions as a confirmatory element for others, without the need to reveal the identity of the complainant. whistleblower, as ruled by the Supreme Court.
Jurisprudence, explains the teacher, requires that this information be supported by some data, facts or circumstances of knowledge that serve to delimit typical behavior and its attribution to the accused. Furthermore, he adds, jurisprudence indicates that “in general, a piece of news alone does not legitimize any popular actor to convert the journalistic story into a story of punishable acts that trigger criminal proceedings. We need something more.”
For Pedraz, in the case of the PP complaint, that “something more” as shown by reading what is reported in the complaint does not occur, since from what has been done to date in this case there is no connection with what was reported.
Also, warns the magistrate, “contradictions emerge on the part of the anonymous complainants, as underlined by the Public Prosecutor’s Office when it underlined that the treatment falls to the Ministry for the Ecological Transition and not to the Cabinet Director of the Minister of Industry, to whom adds a report which appears in some previous D. of the Central Court of Secondary Education and also contradicts the said complainants.
Therefore, the complaint should be inadmissible, without prejudice to what the investigation might bring.
In the same order, the head of the Central Court of Education Cinque admits the appearance of popular accusations against the PP, Mani Pulite, the Hazte Oír Association and Vox, after having paid a bail of 10,000 euros.
In another resolution, the magistrate keeps the businessman Víctor de A. in prison without bail to prevent him from obstructing the action of justice.
In an order in which he rejects the entrepreneur’s appeal for reform, Pedraz recalls that multiple pending proceedings have been agreed upon and that everything found in the documents remains to be analysed. He adds that a significant part of the defrauded amount, almost 74 million euros, may have been transferred to foreign accounts, so it is necessary to identify and block it, as well as ascertain the money laundering operations allegedly carried out, measures “that would be frustrated or, at least, hindered, if the person under investigation was free”.
