Kochi: The High Court has rejected a petition seeking the inclusion of the Scheduled Castes and Scheduled Tribes Prevention of Torture Act against Arjun in the Vandiperiyar Rape Case in which a six-year-old girl was raped and hanged. The court also said that the department would not exist as the accused Arjun also belonged to the SC category. The child’s mother had approached the court alleging that the SCST Atrocities Act police had deliberately omitted the accused in the case. The High Court had earlier sought an explanation from the government in the incident. Accordingly, the caste certificate issued by the Revenue Department to the accused and his sister was submitted to the High Court by the police.

Last June, a six-year-old girl from Vandiperiyar Churakkulam Estate was hanged after being molested by a young man in the neighborhood. The police immediately arrested the accused Arjun and charged him with rape, murder and pox within 45 days. However, the Scheduled Castes and Scheduled Tribes Prevention of Torture Act was not enacted to further strengthen the case. The section was omitted on the ground that the accused Arjun also belonged to the same category. But years ago, the family of the accused Arjun converted to Islam.

Despite the girl’s parents and public activists pointing this out, the department refused to add. The complaint was lodged with the DGP and the Chief Minister. Yet no action was taken. With this, the parents approached the High Court. Following this, the High Court rejected the demand to include the Scheduled Castes and Scheduled Tribes Prevention of Torture Act against Arjun.
