For this reason, a dialogue with the Ministry of Labor and Social Welfare (STyPS)where delivery people from Mexico City (CDMX), Chihuahua, Guadalajara, León and Toluca participated, however, no agreement was reached.
In an interview for SDPnoticias, Saul Gomez, deliveryman and founder of “Not a deliveryman less”, and Gabriel Diaza digital platform delivery person, told about the reform promoted by the federal government and the clauses that harm workers and merchants.

Uber, Didi and Rappi delivery workers point out that Claudia Sheinbaum’s reform could harm them
Gabriel Díaz told SDPnoticias that the reform of digital platforms has mixed opinions among delivery workers, as there are those who are in favor and others against.
The deliveryman indicated that in his case the reform promoted harms you due to the fixed hours that will be established when giving a base salary, as well as the social security payment.
As he explained, He and many of the digital platform delivery drivers carry out this work as an extra job.with free time and as it suits them, since they have a formal and permanent job where they work according to the Labor Law in Mexico.
For his part, Saúl Gómez pointed out that the demands of the delivery drivers are clear regarding fixed hours and salaries, as well as the opening for each worker, as appropriate.
The digital platform distributor shared that they seek openness to dialogue to express their concerns about the aforementioned reform, since although social security is not a problem, formalizing their jobs could be counterproductive.
“The platforms could not do it, we are worried about that because many states would be left out“, he shared with SDPnoticias, and assured that there are only 6 entities that handle the greatest demand for service, so the rest would remain in doubt as to whether the work continues or not for the delivery people.
For this reason, he pointed out that “there have to be options” regarding the reform for workers of Uber, DiDdi, Rappi and other digital platforms, “because Not everyone can or wants to enter the scheme that is being proposed”.
In addition, he accused that, in addition to the delivery people, thousands of other people would lose their jobs in restaurants, inns and other places that offer their food through Delivery.

Saúl Gómez shared with SDPnoticias that given Claudia Sheinbaum’s reform to digital platforms guarantees are requested from the federal government, among them:
- Flexibility of schedules
- That if work schedules are imposed, it is guaranteed that the profits continue to be those currently received by the delivery workers (from 400 pesos in 2 hours to 12 thousand for 7 days worked)
- That jobs for delivery drivers continue in all entities
He pointed out that do not disagree with having health insuranceHowever, he recalled that in July 2024 the delivery drivers of Uber, DiDi and other digital platforms made a agreement to receive medical care from IMSS-Bienestar.
In addition, he said that they currently have life insurance provided by platforms such as Uber, Didi and others, which covers possible accidents from the moment they receive the order until 30 minutes after delivering it.

Saúl Gómez shared that the delivery drivers bet on “a dual scheme” like the one handled in the United Kingdom, where you are from “worker o employer”.
In that sense, he pointed out that “If you are an employer you are subordinate, if you are a worker you maintain your flexibility”and that they propose to the federal government, headed by Claudia Sheinbaum, that this model be applied in Mexico.
It should be noted that in the United Kingdom it has been ruled on 3 occasions that delivery people are “autonomous”, and they do not have the right to collectively negotiate their working conditions and salaries.
This situation applies to digital platforms like Deliveroo, while At Uber, drivers are classified as workers, not self-employed contractors.
“Why not bet on this?” said Saúl Gómez, who also accused that Claudia Sheinbaum’s reform “contradicts” many norms, which is why some of her proposals are intended to be accepted.
It should be noted that during the work table between the delivery drivers of Uber, Didi, Rappi, and more digital platformss, an agreement was not reached with the representatives of the federal government, However, the proposed reform was delivered to them in writing.
In that sense, it was indicated that the Delivery workers may submit corrections in the pilot projectso we are working with legal advisors to present a reform alternative that benefits everyone and includes the proposed dual scheme.
This proposal will be delivered on Friday, October 25 to the Ministry of Labor and Social Welfare (STyPS), Saúl Gómez pointed out for SDPnoticias, who added that although the initiative has already been presented, it is not ruled out that its proposals will be taken into account.
“We have suggested the implementation of the dual system also so that the government realizes what those of us who collaborate on digital platforms really want.
We have a deadline to deliver it on Friday, we still do not know if digitally or in person, but we are already working with some lawyers who have supported us for some time to be able to express our needs in the reform and present another alternative.
