As the Democratic Party of Korea passed the ‘Permanent Special Prosecutor Rules Amendment’ at the plenary session of the National Assembly on the 28th, the way was opened for the special prosecutor recommended by the opposition party to investigate suspicions related to First Lady Kim Kun-hee. While the Democratic Party is concentrating its power on re-voting the ‘Kim Kun-hee Special Prosecutor Act’ on the 10th of next month, it is embarking on a ‘double strategy’ to supplementally investigate suspicions related to Ms. plan. If President Yoon refuses or postpones the appointment of a permanent special prosecutor, the policy is to press for impeachment for violating the current law.
● Bypassing the ‘Kim Kun-hee investigation’ with a permanent special prosecutor without the right to veto
The ‘Amendment to the Rules for Recommending Permanent Special Prosecutor Candidates’, which was passed at the plenary session on this day, excludes the two candidates recommended by the ruling party out of the four recommended by the National Assembly from the seven-member Permanent Special Prosecutor Candidate Recommendation Committee in cases of investigations involving the President or his family. It contains. Accordingly, the Democratic Party recommended two people, and the Fatherland Innovation Party and the Progressive Party, which have the next largest number of members, recommended the remaining two people. The Progressive Party has the same number of lawmakers as the New Reform Party (3), but is ahead in number of members. The ‘permanent special prosecution rule amendment’ is not subject to the President’s veto as it is a National Assembly operating rule.
The Democratic Party is considering submitting a request for a permanent special prosecutor’s investigation on the 10th of next month, when the ‘Kim Kun-hee Special Prosecutor Act’ is scheduled to be re-approved. A Democratic Party official said, “As the re-approval of the Special Prosecutor Kim Kun-hee Act has been delayed by about two weeks, we are also considering a plan to process the investigation request simultaneously.”
In the ‘Permanent Special Investigation Investigation Request’ submitted last month, the Democratic Party specified as targets of investigation suspicions of manipulation of Sambu Engineering & Construction’s stock price, suspicions of external pressure on customs drug investigations, and violations of the law on testimony and appraisal in the National Assembly. The Democratic Party is considering adding the allegations of ‘Deutsche Motors stock price manipulation and Myung Tae-gyun’s involvement in government affairs’ to the list of permanent special prosecutors’ investigations if the special prosecutor Kim Kun-hee bill is rejected in a re-vote.
However, in the case of a permanent special prosecution, the investigation period is up to 60 days, and the investigative staff is limited to 5 dispatched prosecutors and 30 dispatched public officials. The scale is very small compared to the maximum investigation period of 150 days and 30 and 60 dispatched prosecutors and public officials, respectively, as stipulated in the Special Prosecutor Kim Kun-hee Act, which passed the plenary session of the National Assembly on the 14th. Regarding this, even within the opposition party, there was an interpretation that “unless the charges are very simple, it will be difficult to uncover the truth through a permanent special prosecutor.”
Nevertheless, the Democratic Party’s decision to bring out the permanent special prosecution card is interpreted
to be based on the judgment that the permanent special prosecution can also be used as a reason to push for the impeachment of President Yoon. If the special prosecutor candidate recommended by President Yoon is not appointed after the request for a permanent special prosecutor’s investigation passes the plenary session of the National Assembly, it will be clear grounds for impeachment for the president’s violation of the law. According to the Special Prosecutor Act, the President is required to appoint one of the recommended candidates as a special prosecutor within three days from the date of recommendation from the Special Prosecutor Candidate Recommendation Committee. A key member of the Democratic Party said, “I believe there is a high possibility that the president will use a delay strategy without appointing a permanent special prosecutor,” and added, “If this happens, it will clearly become grounds for impeachment in the future.”
●Lee showed the Sambu Construction chart and said, “It’s just stock price manipulation and a permanent special investigation is being pursued.”
Lee Jae-myeong, leader of the Democratic Party, also mentioned the suspicion of Sambu Construction stock price manipulation on the same day, emphasizing the need for a permanent special investigation. At the ‘Korea Stock Market Revitalization TF on-site meeting’ held at the Korea Exchange in Yeouido, Seoul on this day, CEO Lee showed Sambu Construction’s stock chart directly on his cell phone screen and said, “(Sambu Construction’s stock price) increased from KRW 1,020 to KRW 5,500. “The ship has risen,” he said, adding, “Anyone who has done a little bit of stock trading will clearly see that it is a stock price manipulation.”
The opposition party claimed that Sambu Construction’s stock price rose sharply when President Yoon and his wife met with the Ukrainian president’s wife and announced the Ukraine reconstruction project after Lee Jong-ho, the broker in the Deutsche Motors stock price manipulation case, sent a group message saying, “Check Sambu tomorrow.” Suspicions are being raised. CEO Lee said, “Making unfair profits by manipulating stock prices should never be tolerated,” and added, “In the case of Sambu Engineering & Construction, if we closely investigate who actually invested the money, everything will come out. He said, “If we push for a permanent special investigation, won’t we see tangible results?”
