MK Encouraged to Filter Regional Election Dispute Cases That Are Not in Its Authority

jpnn.comJAKARTA – The Constitutional Court (MK) was asked to screen every report of dispute over the results of the 2024 Regional Head Election (PHP Kada).

This was conveyed by Constitutional Advocate Viktor Santoso Tandiasa considering the large number of disputes over Kada PHP.

This dispute was submitted after the Provincial, Regency/City General Election Commission (KPU) determined the results of the candidate pairs’ votes.

“I hope that the Constitutional Court will continue to maintain its grace, as it did in handling the 2024 General Election yesterday, as a guardian of democracy,” said Viktor in a written statement, Sunday (15/12).

In handling the Kada PHP case, VST and Partners, led by Viktor, holds two Kada PHP cases in the North Morowali Regency area, namely Delis-Djira and Banggai Islands, namely Rusly-Serfi.

The two of them became related parties in the Constitutional Court because the position of regional head candidate pair held by Viktor received the most votes with a significant difference, namely 6.81 percent for North Morowali and 4.07 percent for Banggai Islands.

Apart from these two regions, there are still three more districts/cities which are planned to hand over power to Viktor to become related parties.

As a related party, he hopes that the Constitutional Court will continue to pay attention to the threshold requirements as regulated in Article 158 of the Regional Election Law regarding the Constitutional Court’s authority to hear the case requested.

Viktor assesses that the dismissal process which is preceded by a Judges Consultative Meeting (RPH) can be used as part of sorting out cases.
