The deadline for delivering the bonus to workers is very close, so if your job has not yet given it to you, you must be very attentive to be able to claim your right to this benefit that by law must be granted to you.
Article 87 of the Federal Labor Law indicates that workers have the right to receive an amount of money equivalent, at least, to 15 days of salary, which is called a Christmas bonus.
In addition, those who have not yet completed one year of service, whether or not they are working on the date of settlement of the benefit, have the right to receive the proportional part of the bonus, according to the time they have worked.

When is the deadline to receive the bonus?
The Federal Labor Law stipulates that the deadline for companies or employers to deliver the bonus payment to workers is December 20.

What happens if they don’t pay me the bonus?
It is important to know that there is an institution in charge of ensuring that workers’ rights are fulfilled, including the delivery of the bonus payment in a timely manner.
For those who receive payment in a single payment, being aware of the payment deadline is important to make the claim in a timely manner, through the Federal Labor Defense Attorney’s Office (PROFEDET).
You can file a complaint with this institution against your employer to report the lack of payment of the bonus that corresponds to you and here we will tell you how to do it.
How do I file my complaint if they don’t pay me the bonus?
If you did not receive your bonus before December 20, you must contact PROFEDET to receive guidance regarding said benefit and then go to the nearest Federal or Local Conciliation Center and explain to the staff the situation of the delay in payment of your bonus. .
The Conciliation Center will summon your employer and you to promote an agreement that leads to the prompt payment of your benefit and thus prevent the situation from escalating into a labor lawsuit.
When the conciliation process does not resolve the conflict, as a worker, you can claim payment of your bonus through a trial before the Labor Courts, for which you will need the services of a lawyer specializing in labor law.
PROFEDET will be able to provide you with a lawyer free of charge if required.
