The Rajasthan High Court has granted 15 days parole to a wife who wanted to have a child through her convicted husband.
Nandalal, a native of Ajmer, Rajasthan, has been arrested and jailed in connection with a murder case. He has been sentenced to life imprisonment. He has been in prison for the past few years. Nandalal is married and has a wife named Rekha. Meanwhile, Nandalal’s wife Rekha filed a petition in the Rajasthan High Court seeking her release on parole for engaging in a marital relationship with her husband and having a child through him.
The Rajasthan High Court, which heard the case, said, “It is a fundamental right of a lifer’s wife to have a child. Preventing a husband from having a child even if he has not committed any crime will adversely affect the wife’s rights. ” The court also noted that marital relationships can help normalize an offender and change their behavior.
The court insisted that the wife should not be forced to suffer without a husband and children without committing any wrongdoing. The Rajasthan High Court has granted a 15-day emergency parole to life-sentenced prisoner Nanda Lalu for having a child in a marital relationship with his wife in the absence of any explicit rules.
