Austrian Woman Sues After False Lung Cancer Diagnosis Leads to Unnecessary Surgery
A Styrian woman is pursuing legal action after a devastating misdiagnosis of lung cancer prompted the removal of a portion of her lung, despite being completely healthy. The case, brought to light by reports from Hello TV and the KURIER, highlights the potential for catastrophic errors in medical diagnosis and the profound impact on patients’ lives.
The ordeal began in September 2024, when the patient presented at a hospital in Graz with symptoms including fever, chills, and headaches. Initial tests revealed elevated inflammation levels and what doctors described as a “tumorous event” in the lungs. While further examination failed to identify an actual tumor, a subsequent tissue sample erroneously indicated the presence of tumor cells, leading to a diagnosis of lung cancer.
Following the diagnosis, the patient underwent surgery at a private clinic, resulting in a piece of her lung being removed. However, a later review determined the initial findings were incorrect – the patient was, in fact, cancer-free. “The pathological findings are currently being re-examined,” according to the statement of claim.
The emotional and physical toll on the patient has been significant. Represented by lawyer Karin Prutsch-Lang, the plaintiff reports suffering not only from the physical trauma of the surgery – including a 15-centimeter scar causing numbness and tension – but also from severe psychological distress. “Since the operation, her client has been suffering ‘not only physically, but also mentally,’” Prutsch-Lang stated. The patient has experienced sleep disorders and, overwhelmed by the situation, even drafted farewell letters.
The lawsuit alleges errors in both information and treatment provided by the medical team. The hospital holding company, KAGes, released a statement on Wednesday declining to comment on the specifics of the case, citing ongoing legal proceedings. “The court will clarify the complex facts. We ask for your understanding that due to the ongoing proceedings, the KAGes cannot currently provide a statement,” the company said.
