Utah District Judge Tony Graf ruled Tuesday that Tyler Robinson, 23, will stand trial for the aggravated murder of conservative activist Charlie Kirk. The decision allows prosecutors to pursue the death penalty, following a ruling that Robinson knowingly endangered a crowd of thousands during the September 10, 2025, shooting at Utah Valley University.
The ruling follows months of legal disputes over whether the killing of the 31-year-old activist met the legal threshold for a capital offense. Robinson entered a plea of not guilty on Tuesday to seven charges, including aggravated murder, after Judge Graf found the state had met the probable cause requirement for all counts.
The ‘Zone of Danger’ and the Death Penalty
The central conflict in the preliminary proceedings focused on whether Robinson’s actions posed a great risk of death to others, a necessary aggravating factor for a death penalty charge in Utah. Prosecutors alleged that Robinson fired a high-powered rifle from a rooftop more than 400 feet away, placing Kirk and a crowd of over 3,000 people at risk.
Utah County prosecutor Ryan McBride argued it was common sense that firing into such a large gathering created an inherent risk. McBride told the court that you can’t shoot a rifle into a crowd of 3,000 people and not know that you are posing a significant risk of death.

Defense attorneys Staci Visser and Richard Novak countered this narrative, arguing that because only a single bullet was fired and it struck the intended target, the crowd was not at risk. Visser emphasized the singularity of the event, stating, There is one act, there is one shot, there is one bullet, there is one victim

Judge Graf rejected the defense’s attempt to downgrade the charges to murder—ruling that the documented position of individuals in and around the canopy area supported a reasonable inference that Robinson was aware of the bystanders when he fired.
Political Motive and Forensic Evidence
Prosecutors are seeking further sentencing enhancements by alleging the shooting was politically motivated.
McBride told the court during the state’s closing arguments that the defendant’s views were repugnant to the positions that Charlie Kirk famously took.
The state’s evidence includes a Mauser .30-06 caliber bolt-action rifle found the morning after the killing. Other evidence presented during a five-day hearing in July included security video showing Robinson arriving on campus and buying a meal from a campus Chick-fil-A restaurant hours before the shooting.
Robinson was arrested after a relative informed police that the young man “had confessed or implied that he was the shooter.” According to investigator testimony, Robinson later told a witness he wishes he hadn’t done it

Impact on the Kirk Family and Turning Point USA
The ruling comes nearly one year after the assassination of the Turning Point USA co-founder, who was in Orem to kick off his American Comeback Tour. Erika Kirk attended the hearing alongside Robert and Kathryn Kirk. The family released a statement saying, Today's decision, which comes nearly a year since Charlie was taken from us, marks an important step in our family's pursuit of justice for him.
The courtroom atmosphere reflected the high stakes of the case, with a few local members of Charlie Kirk’s organization, Turning Point USA, arriving with signs expressing support. Judge Graf allowed the proceedings to be livestreamed by Salt Lake City TV channel KUTV despite defense objections that such coverage jeopardizes his right to a fair trial.
With the probable cause hurdle cleared, the next court date was set for Oct. 23. Robinson remains facing seven counts, with the aggravated murder charge serving as the primary mechanism for a potential capital sentence.
