New Delhi> Supreme Court upheld broad powers of Enforcement Directorate (ED). The Supreme Court upheld the ED’s powers of arrest and confiscation of assets under the Prevention of Money Laundering Act, 2002. The Supreme Court also said that Section 5 of the Prevention of Black Money Act is not unconstitutional.

The verdict is in 242 petitions filed by Karti Chidambaram and former Maharashtra minister and NCP leader Anil Deshmukh, questioning the provisions giving wide powers to the ED. The Supreme Court has come under criticism that the central government is misusing the ED in many states for political purposes. The verdict was given by a bench comprising of Justice AM Khanwilkar, Justice Dinesh Maheshwari and Justice CT Ravikumar.

The court said that there is no need to give the entire enforcement first information report to the accused and if the accused is detained, he can get an FIR through the court if necessary. The court also stated that the strict provision for bail is constitutional. The Supreme Court has also directed to transfer the petitions to the High Court to change the trial in the ED case.
