The judges Jorge Patrizi and Roberto Reyesconfirmed that the teacher Juan Trigatti remain free until trial. The teacher is accused of sexual abuse of minors, which would have been committed in the Ceferino Namuncurá garden in the city of Santa Fe. According to his defense attorney, Marcos BarceloThey will go through the oral trial to prove their innocence.
“In a recent hearing, the issue of pre-trial detention was discussed, along with various pieces of evidence. The lawsuit and the prosecution appealed several aspects of Dr. Patrizi’s decision. Judge Reyes, the chamberlain, confirmed the decision, and ratified the freedom of the teacher Juan. We estimate that the trial will take place in 2023, due to the number of cases between now and the end of the year,” explained the criminal lawyer for chain OH!.

The hearing included the participation of the defendant himself who, according to Barceló, “was forceful. I am one of the few criminal lawyers who believes that the defendant’s defense is more important than the technique. I always talk to clients that they have to defend themselves with nails and teeth. Juan Trigatti spoke and was forceful. When you are defending a person who is convinced that he is innocent, it is different; material defense is essential”.
For the interviewee, Trigati is not going to slow down yet go to trial and prove that he is innocent. “His goal is to clear his name in front of family and friends.also before the community”.
Contrary to the arguments of the prosecution and the complaint about the defendant’s loss of employment and housing, Barceló stated that the community contributed to the reconstruction of the home of the Trigati family, destroyed last year after the denunciation.
“This is a very strange case. Thanks to the economic support of the community, because the whole community supported this, home of the Trigatti family was rebuilt by a specialized company who left the home as it was. Today it is rented, because the family admitted that they can never return to that place, it will remain as real estate, “she explained.
On the other hand, the teacher did not lose either of his two jobs, he only took out a psychiatric folder.

In this sense, Barceló stressed that both the Inter-American Court of Human Rights and the Supreme Court of the Nation affirm that the deprivation of liberty is justified if there are objective causes of hindering escape or hindering evidence. Generic causes cannot be taken. “Neither the prosecution nor the complaint were able to prove an objective cause because there is none. We decided that Juan would not even participate in interviews, because he could generate discomfort or some kind of pressure, “he finally said.
