Kochi: The High Court stayed the court order granting anticipatory bail to writer and activist Civic Chandran in a sexual harassment complaint. The anticipatory bail was stayed in the case registered by the Koyilandi police in the case of sexual harassment of a young woman at Nandi Katappuram in Kozhikode. Meanwhile, the court ordered that Civic Chandran should not be arrested. The court also stated that the arrest is prevented considering the age of the accused. The High Court criticized the action of the Kozhikode District Sessions Court judge who granted anticipatory bail. The High Court observed that the anticipatory bail was granted after examining irrelevant reasons. There is an error in the exercise of jurisdiction by the court. The court also stayed the controversial remarks in the order granting anticipatory bail. The court also stated that the stay will remain in place until the final judgment is passed on the appeal filed by the government against the grant of anticipatory bail.

It was pointed out in the petition that the observation of the lower court is unreasonable and questioning the constitutional freedom of the young woman. Kozhikode District Sessions Judge S. Krishnakumar, who made controversial remarks by granting anticipatory bail to Civic, was transferred yesterday evening. He was transferred as Kollam Labor Court Judge. S.Muralikrishnan is the new Kozhikode District Sessions Judge. Four district judges including this were transferred yesterday. The High Court had earlier sent a notice to Civic Chandra in the first case of molestation of a Dalit woman.

The court’s opinion was that the woman who had filed a sexual harassment complaint against Civic Chandran was dressed in a provocative manner. This reference is in the order issued by granting anticipatory bail to Civic Chandran in the second sexual harassment case registered by the Koyilandy police. The court found that Section 354A was not applicable as the complainant was wearing provocative clothing. In the order granting anticipatory bail, the court observes that the dress of the young woman is clear in the photo presented by the defendant in the court.

High Court notice to writer and activist Civic Chandran in case of molestation of Dalit woman. The court sent the notice on the petition of Atijeevtha who questioned the granting of anticipatory bail in the sexual harassment case registered by the Koyilandy police. The petitioner told the court that the lower court order granting bail was against the Prevention of Atrocities Against Scheduled Castes Act. The complainant raised that Civic Chandran sexually assaulted her knowing that she was a Dalit woman. The Additional Sessions Court held that prima facie this statement was not credible and told the Atijeetha Court that it was completely wrong.
