New Delhi: The case seeking to frame guidelines on the circumstances under which punishment should be considered in cases where capital punishment is imposed has been transferred to a 5-judge constitution bench.

For many years, there has been a demand that guidelines should be laid down in cases where capital punishment is likely to be imposed, and the Supreme Court has taken up this demand voluntarily. Justice Ravindra Bhatt, who heard the arguments in the case, recently ordered that the Chief Justice will give the final verdict.

Chief Justice U.U.Lalith, who heard the case, ordered, “It would be right if a constitutional bench comprising of 5 judges investigates and gives a verdict on the circumstances under which the punishment of a criminal facing the maximum death penalty should be considered.”
