New Delhi: The Delhi High Court said that the accused cannot be granted bail in the case of sexually assaulting a young woman after her engagement and forced her to have an abortion. Denying bail, the court said that there is no right to forced sex or beating on the grounds of being engaged.

The court pointed out that according to the woman’s statement, she had sex with the assurance that they would get married. Moreover, the court said that the fact that the woman was engaged did not mean that the accused could sexually harass or beat the woman. In this case, the woman’s lawyer argued that the girl was beaten, forced to have sexual intercourse, given pills for abortion.

The petitioner argued that this case came into existence after the accused and his family members refused to marry and there was no rape or sexual assault in the earlier complaint. The court rejected the defendant’s argument that there was no evidence of forced abortion. The court also pointed out that an unmarried woman will not keep evidence of sexual intercourse for her pride. The court also said that the accused cannot be granted bail in the case where the court proceedings have not started.
