Supreme Court dismisses Smartha Brahmins petition | Dinamalar

New Delhi, The Supreme Court yesterday rejected the appeal petition of ‘Smartha’ Brahmins from Tamil Nadu seeking to declare themselves as a minority.

Tamil Nadu is inhabited by Smartha sect Brahmins who follow Advaita religious philosophy. They filed a petition in the Madras High Court seeking to declare themselves as minorities.

Hearing the petition, the High Court said, ‘There is no common organization in the name of Smartha Brahmins. There is no peculiarity to distinguish them from other Brahmins living in Tamil Nadu.

‘They cannot consider themselves a sect. Therefore, they are not entitled to benefits under Article 26 of our Constitution.’

This was appealed to the Supreme Court. The petition came up for hearing yesterday before a bench comprising Justices Krishna Murari and Ravindra Bhatt.

Then, ‘Smarta Brahmins do not belong to a separate sect. The High Court upheld the order stating that ‘minority status cannot be granted to them’ and dismissed the petition.
