New Delhi: The Supreme Court has ordered the release of Manichan, who is in jail in the Kalluwathukkal disaster. A bench comprising Justices Aniruddha Bose and Vikram Nath stated that release cannot be denied on the ground of non-payment of fine. Manichan, who has been imprisoned for 22 years, had earlier been ordered to pay Rs 30.4 lakh for his release.

In addition to life imprisonment, Manichan was ordered to pay a fine of Rs 30 lakh and forty five thousand in connection with the Kalluwathukkal alcohol disaster case. The court also decided to pay this penalty to the victims. Although the sentence was commuted in the case, Manichan remains in jail as he has not paid the fine. Manichan’s wife Usha approached the Supreme Court in this situation.

According to the instructions of the Supreme Court, the state home department had issued an order for Manichan’s release from jail. But the government had given an affidavit in the High Court yesterday that the release of Manichan was not possible due to non-payment of the fine. Manichan is the main accused in the Kalluwathukkal alcohol disaster case in which 31 people died. The stone pelting disaster occurred on October 21, 2000.
