This call is intended for entities and/or authorities that wish to take part in the project carried out in cooperation between the Harlbad (hereafter: “the authority”) and the entrepreneur Rotem Rogovski (hereafter: “the developer”). As part of the project, the entrepreneur will take a “Tetris picture” – the image It will be photographed for a few hours using a drone and will include various means of transport and accessories from the field of road safety (hereafter: “the picture”). This is a voluntary initiative, free of charge, to which the conditions detailed below will apply.
The developer wishes that the photo will include various and diverse vehicles and accessories from the field of transportation and road safety, and therefore entities that are engaged in this field are invited to submit their proposals for participation in the photo.
The promoter will have the sole discretion in choosing the entities that will participate in the picture and he does not undertake to select any entity that submits its proposal to this call. The entities will not be able to raise any claim against the authority and/or against the developer in the event that the developer decides not to share the photo. It will also be clarified that the authority is not responsible and will not be responsible for any commitments and/or presentation presented by the developer and it publishes this call to help the developer implement the image.
It will also be clarified that the submission of proposals for this call does not oblige the entities to participate in the photo and the entities will be entitled to decide whether to participate in the photo after the promoter defines the obligations required for such participation.
The promoter will own the copyright in the image and will be entitled to make any use of it as he sees fit, including, but not limited to, participating in competitions, advertising, selling, etc. The promoter does not undertake to give credit and/or mention the names of the entities and the entities will not be able to make any claim in this regard.
Entities wishing to submit their proposals are required to do so by the day 12.9.2022 16th of Elul 2022 at 12:00. It will be clarified that Haralbad does not guarantee that the project will be implemented within the next month and/or at all, and that not every bidder who submits an application to participate in the project will be approved for participation.
The entities must attach to their proposals a list detailing the vehicles and/or accessories they can assign for the purpose of taking the photos. It will be clarified that the participants will have to sign that they have insurance as detailed below.
The entities and/or authorities that will participate in the project undertake to take out all the required insurances including, but not limited to, mandatory, comprehensive and third party insurance in acceptable scopes for the vehicles that will participate in the project. It will be clarified that in any case the authority is not and will not be responsible for any damage caused to any of the participants in the photo and will not raise any claim and/or claim against the authority as a result of any damage caused, to the extent that it is caused.
Warranty and insurance
In addition, the bodies and/or the authorities undertake to take out third-party liability insurance with a liability limit of no less than NIS 4,000,000 and employers’ liability insurance with a liability limit of no less than NIS 20,000,000.
The insurances will include a waiver of subrogation towards the Authority and/or the State of Israel and/or anyone on their behalf, as well as the insurances will be extended to indemnify the Authority and/or the State of Israel for an act and/or omission of the entities and/or the authorities subject to the cross liability clause. In addition, the insurances will be primary and prior to any insurance taken out by the authority and/or the state and/or for their benefit.
The entities release the Authority and/or the State of Israel and/or all those acting on its behalf from any liability for damage or loss caused to property and/or equipment and/or tools and/or facilities owned and/or under their responsibility and/or under their supervision and/or any property used the bodies for the purpose of this project, whether insurance was taken out or not (and if it was not taken out even if it were not for the self-reports and/or lack of insurance and/or the violation of the terms of the policies) and they release all the above-mentioned parties from any responsibility for such damage except for a person who caused to maliciously damage.
