A court recognizes the right of the Church to recover possession of an occupied building in Zestoa (Gipuzkoa) and orders its “immediate eviction”

The Court of First Instance and Instruction number 2 of Azpeitia has upheld the lawsuit filed by the Parish of the Nativity of Our Lady of Zestoa against two people and “other unknown” occupants of the Elizondo building in this Guipuzcoan town and, after recognizing the right of the Church to recover possession of that property, has condemned the defendants to “proceed with the immediate eviction of the property and delivery to the plaintiff, under warning to otherwise proceed with its release.” It has also established that the defendants must “refrain from observing or promoting any conduct, active or passive, direct or indirect, that may constitute a disturbance of the rights” of the parish “over the property that is the subject of the lawsuit.” The head of the court considers that in the hearing…
