The Eibar Social Court has condemned the GSR cooperative of Arrasate for “violating the fundamental right to dignity and professional promotion” of an auxiliary worker at a gerocultural clinic, IE O, who was forced to carry out cleaning tasks, Therefore, it declares the business decision null and void and sets compensation of 15,626 euros.
The sentence, to which this newspaper has had access, dates from last March 20 and considers it proven that the company made the decision to entrust the worker with the home care of several people with tasks unrelated to those of her profession as an assistant of clinic-gerocultor. These tasks included cleaning the kitchen, vacuuming, taking out the garbage, ironing clothes…
The ruling considers that these tasks violate the worker’s fundamental right to dignity and professional advancement, and therefore orders their cessation and the reinstatement of the worker to her clinical assistant tasks, which she had been performing since 1986.
The lawyer who has represented him, Beatriz Alzugaray, values the ruling, which can be appealed, since it highlights that “sentences for violation of fundamental rights are exceptional.”
