a federal judge gave a partial victory this Wednesday to the writer EJ Carroll, who denounced the former president of the United States Donald Trump for sexual assaultby ruling that the court that examines a second complaint for defamation in January 2024 must limit itself to determining the amount of compensation, since the sexual abuse was proven in a previous process.

Judge Lewis Kaplan’s sentence means expediting the second trial, since it limits it to the Financial compensation that Trump must pay to the writer Elizabeth Jane Carroll for calling her “crazy” and for assuring that his claims about the sexual assault he suffered in the 1990s were “false,” the Europa Press news agency reported.

He is referring to statements that the former president made in 2019, after Carroll publicly stated for the first time that Trump sexually assaulted her in a luxury department store in the 1990ssomething he denies.

“The jury considered and decided issues that are common to both cases, including whether Mr. Trump falsely accused Ms. Carroll of fabricating her sexual assault allegation and, if so, that he did so knowing that this allegation was false. ” either acted with reckless disregard for the truthUS District Judge Lewis Kaplan wrote Wednesday.

For his part, Carroll and his attorneys “they hope the trial will be limited to damages for the original defamatory statements made by Donald Trump“said his attorney Roberta Kaplan, who is not related to the judge.

Trump’s lawyer Alina Habba said her legal team is confident the jury’s verdict will be overturned.leaving without effect the new decision of the judge.

The trial, in which the former president is not expected to attend, will begin in New York in January and it will take place after a federal jury in Manhattan found Trump guilty last May of sexually abusing Carroll.

Carroll sued Trump for the sexual assault that occurred in 1996 in some fitting rooms of Bergdorf Goodman, a luxury department store in New York.

However, Trump denied such facts, accusing her of making it up to sell a book and destroy him politically.

The process will take place in the middle of the Republican primariesin which Trump starts as the favorite, and as the magnate faces four other criminal trials for keeping classified documents after leaving the White House and for his role in the assault on the Capitol on January 6, 2021.

He also faces legal proceedings for trying to change the results of the 2020 elections in the southern state of Georgia and another for paying a porn actress to keep quiet about an affair with the former president in 2016, before he was elected.
