A lawyer, registered in A Coruña, faces a possible prison sentence of six years in prison for allegedly defrauding a client who was in jail serving a sentence for a crime of sexual abuse.
The trial is scheduled to take place this Wednesday, May 24, in the Provincial Court of Lugo. The public prosecutor accuses him of professional disloyalty and the continued crimes of falsehood in private document and fraud“in its modality aggravated by having been perpetrated taking advantage of his professional credibility.”
According to the indictment of the Prosecutor’s Office, the lawyer began to provide legal assistance to his client before February 2016. A year later, in 2017, His sponsor entered the Monterroso penitentiary center to serve a sentence of 3 years and 10 months in prison as a result of a final sentence of the Second Chamber of the Supreme Court for a crime of sexual abuse.
The lawyer, who maintained “frequent” contact with the convicted man and his sisters, informed them of his intention to file an appeal “based on the appearance of new evidence”, although He also told them that he had to wait for the resolution of an amparo appeal before the Constitutional Court that he already knew had been inadmissible.
Moreover, according to the prosecutor, in 2018, It led them to believe that said appeal for amparo was “close to being resolved in a manner favorable to their interests,” which would facilitate their release. To do this, he asked them to give him 2,500 euros, intended to pay a supposed bail.
HABEAS CORPUS
Since his client was not released from prison, the lawyer supposedly he told his relatives that the delay was due to a strike by officials of the Chantada Court.
In fact, in April 2018, “believing the version of his lawyer”, the convicted person requested a “habeas corpus”, which was inadmissible by the Court of Chantada “after verifying” that said “resolution did not exist”.
Posteriorly, With the “spirit to enrich himself unjustifiably”, he tried to make his clients believe that the Constitutional Court had increased the bail to 3,500 euros, for which he asked them to pay him an additional 1,000 euros. To do this, he came to make another document that pretended “to be a copy of an order of the Constitutional Court.”
Finally, his client decided to hire the services of another lawyer who asked the defendant to provide him with the documentation related to the convicted person, but “being aware that his conduct seriously harmed the interests” of that person, he did not deliver the aforementioned papers, which led to a “delay in the exercise of legal actions” on his behalf.
The prosecutor asks for the defendant six years in prison, four years of inability to practice as a lawyer and a fine of 10,800 euros.
