Compensation for non-property damages in the amount of BGN 2,000 will have to be paid by a man from Parvomai for beating his neighbor. The district court in the city accepted a civil claim for joint consideration with the case, which it partially upheld.

On November 10, 2022, a first-timer and an acquaintance of his were in a neighborhood restaurant and drank alcohol. Since it was time for it to close and they wanted to continue, they moved into the garage of the second one. Inside they found his son, the other man’s neighbor and another person drinking beer. The two joined the company.

After a while, the host made a remark to his friend over a cup of coffee because he was pulling his neighbor’s beard, but he told him not to worry because they know each other. The man’s phone rang, he left his beard and the neighbor asked who was calling. “Who are you to be looking at my phone”, the first one was annoyed, but despite the exchange of remarks, everyone continued to drink and talk.

It was getting late and the garage owner said he was going to bed. About 30 minutes after midnight, the man with the phone and his neighbor also decided to go home. Their homes were about 700 meters from where they drank. On the way home, however, the neighbor surprisingly punched the other several times in the head and chest.

The victim ran away, and as soon as he got home he woke up his wife. He told her that the neighbor hit him in the head. She noticed that he was bleeding from the nose, he also had blood in his saliva, as well as swelling of the eye. They woke up their daughter, who filed a report at the Regional Office and went to look for the neighbor, but did not find him at their place. When she returned, a police team was already on the scene. The victim also told the uniformed officers that he was the victim of a beating.

They all headed to the garage, where they saw that the neighbor had returned. They called the three present to clarify the situation. Relatives of his neighbor also arrived in front of the victim’s house. A dispute arose – the accused denied hitting the other man. Because of the headache and the alcohol, he began to claim that others had beaten him as well. The police advised him to take a medical and file a complaint with the district office.

After everyone left, the victim’s wife asked her friend to drive them to St. George UMBAL in Plovdiv. There, the man was examined by specialists, and after the examinations he was released for home treatment. Later in the day, he was examined by a forensic doctor, who issued him a forensic medical certificate, and 3 days later, an ophthalmologist prescribed therapy. Due to his injuries, he was unable to work and went on leave from November 15 to 28. You filed your complaint on December 3.

A forensic medical examination was prepared for the victim. The district court in Parvomai accepted that the testimony of the victim’s wife and daughter did not contradict each other and corresponded with the expertise. However, there were discrepancies in what the other group of witnesses said. After an analysis of everything, the magistrates found the neighbor guilty of causing minor bodily harm, resulting in a contusion to the head and chest, facial hemorrhaging and corneal erosions. The defendant is exempt from criminal liability, but must pay an administrative fine in the amount of BGN 1,000. The civil claim filed was for BGN 5,000, but the court judged that the fair amount was BGN 2,000. The defendant must also pay the costs of the case.
