The Committee on Constitutional Guarantees, Human Rights, Collective Rights and Interculturality took cognizance of the resolution approved by the Legislative Administration Council, through which it qualified for processing the draft reforms to the Law on Jurisdictional Guarantees and Constitutional Control, presented by Assemblywoman Cecilia Baltazar.

During her appearance, the proposing legislator stressed the importance of discussing the proposal under a reflective analysis from a multicultural framework.

He stressed that this reform includes more than six fundamental points and, within this framework, the need to incorporate constitutional principles in the field of interculturality and pluriculturality.

He said it was necessary to respect the principle of interculturality and dialogue between indigenous authorities or members of peoples and nationalities.

Baltazar stressed that in cases of indigenous justice and pre-legislative consultations, it is essential that indigenous authorities be able to dialogue and resolve within the framework of the Constitution when the cases are in the judicial unit. According to his presentation, this approach will allow the State to fulfill its great debt to peoples and nationalities.

He also mentioned the need to address the modulation of sentences to avoid unnecessary time and ensure that habeas corpus actions are carried out by the courts that monitor the sentences. This measure seeks to stop the arbitrary actions of some judges in the release of criminals, thus strengthening security.

Regarding reparations, Cecilia Baltazar advocated for clarity in the rulings, including economic and psychological reparations. She also reiterated the importance of defining the institutions responsible for fulfilling these reparations. She suggested clearly establishing reparations for individual, collective and natural rights.

For her part, Paola Cabezas, president of the Constitutional Guarantees Commission, pointed out that this bill qualifies the reforms that are being analyzed from a plurinational perspective. She emphasized the relevance of this reform to strengthen the legal framework in the context of interculturality and pluriculturality, ensuring a more inclusive and representative judicial system of Ecuador’s diversity.
