H&M obtains a judicial respite in the United States. Chelsea Commodore and Rakeedha Scarlett have withdrawn the class action lawsuit they had filed in 2022 in a New York court against the Swedish company for making “false and misleading” statements regarding the environmental impact of its products. The plaintiffs will not be able to file a lawsuit again for the same reason.

Commodore claimed that “H&M has created a marketing strategy to make greenwashing with its products”, with the aim of presenting them as “environmentally friendly, when they are not”.

One of the examples that was exposed is a label that claimed that a specific dress was made with 20% less water, when an independent investigation by the media outlet Quartz revealed that the dress was actually made with 20% more water.

The lawsuit referred to products from the Conscious Collectionthe label with which H&M identified its most sustainable products and which was withdrawn in 2022 after other similar complaints.

In July of that year, the consumer authority in Norway raised concerns about the use of the Higg Index by some brands, including the Swedish chain. The organization even described the use of the index on some occasions as “misleading and, therefore, illegal.”.

The Dutch authorities also opened a similar process, and H&M pledged to “adjust or stop making sustainable claims.” regarding your product or your website.” In addition, the group donated 500,000 euros to “causes that are committed to sustainability in the fashion industry,” with the aim of “compensating for their unclear and fact-based statements.”
