A Turkish citizen with an address in Plovdiv asked to receive humanitarian status in our country because he is gay and in his homeland there was a danger that his brother and other relatives would kill him because of the shame caused. The State Agency for Refugees refused him and he appealed the decision to the local administrative court.

Attached to the case are briefs which state that there is no real threat of torture, inhuman or degrading treatment or punishment in Turkey, because no such action has been taken against the applicant for status either by the official authorities there or by any specific group that the state does not is able to control. Thus, the refugee story told by him is judged to be unreliable and presented only in order to obtain status. “On the other hand, possible threats from members of his own family do not constitute a prerequisite within the meaning of the Asylum and Refugee Act for the granting of humanitarian status, and against such threats the applicant could claim protection from his own state and criminal prosecution against the particular person , which threatens him with murder”, was recorded in the decision of the Plovdiv magistrates, which denied status.
