A voter lawsuit asks to exclude Trump from the elections in Colorado for rebellion

Six Colorado voters filed a lawsuit Wednesday in a Denver court asking for the remove former president donald trump of the state electoral ballots for the November 2024 presidential elections arguing the “rebellion” of January 6, 2021.

The complaint urges the Colorado Secretary of State not to include the former president (2017-2021) as a candidate under section 3 of the 14th Amendment, which stipulates that “no person” may be a congressman or “hold any position, civil or military” if after taking the oath of support for the Constitution “he participated in an insurrection or rebellion against it, or provided aid or comfort to his enemies.”

Backed by the national organization Citizens for Responsibility and Ethics in Washington, the plaintiffs allege that Trump “knowingly and willfully helped and incited the insurrection of January 6 and that as a consequence he was “disqualified” from participating in a new presidential election.

trump is the favorite in primary campaign polls Republicans to be the candidate for that party despite the multiple criminal lawsuits that he faces in several states, including the accusation of wanting to reverse the results of the 2020 elections.

The Colorado plaintiffs argue, among other things, that Trump was in the march “Let’s stop the robbery“, his tweet on the day of the events against former Vice President Mike Pence and the Republican’s request to delay the certification of the election, which Democrat Joe Biden won.

Also object to Trump’s refusal to mobilize federal agents to restore order in the Capitol and to ask the aggressors to leave that compound.

“Four years after taking the oath (…) Trump attempted to overturn the results of the 2020 election, sparking a violent insurrection on Capitol Hill,” the document states.

This is an unprecedented lawsuit that could be followed by other jurisdictions and against others close to Trump and associated with the January 2021 incidents.

Section 3 of the 14th Amendment to the Constitution was passed in 1868 to prevent Confederate officials and military from holding high positions in the federal government. But that section has never been invoked against a former president.
