Abandonment of medical care in the time of Covid, benefit/risk balance of vaccines: “Where there is fear of speaking, there is no democracy”, recalls Dr Benoît Ochs

DEBRIEFING – In Luxembourg, more than 170 doctors have given their support – without wishing to expose themselves publicly – to Dr Benoît Ochs. This Frenchman, a general practitioner who settled in the Grand Duchy, questioned the political and health management of Covid. In particular, he took a stand against the anti-Covid-19 vaccination program for children. First charged and sentenced for his remarks by the Luxembourg courts, before being restored to his rights as a health practitioner, he remains immersed in the heart of a legal battle. In this debriefing, we come back with him to the details of this case which illustrates the fate reserved during the health crisis for doctors who dared to speak out against the doxa of Covid.

Indeed, during his first conviction, Doctor Ochs was confronted with a judge who did not hesitate to qualify him publicly as a “conspirator”, stating that he does not want to read the file.

According to the magistrate, the doctor would have relied on beliefs and not scientific facts. However, the latter only claimed the principle of the risk/benefit balance, relating to the taking of any medicine, in this case a vaccine.

Benoît Ochs presents himself as a “simple doctor” and one “alert launcher” who advocates “humility”. He recalls that “medical follow-up is very important” in order to reduce mortality linked to Covid disease. “Lockdown and home quarantine have been a medical policy disaster”he says.

In his eyes a form of “failure to assist a person in ‘legal’ danger” when defining a protocol that specified “the behaviour to have” regarding quarantines : patients who developed severe forms of the disease were sent to hospital far too late when treatments were available. The doctors could not even have access to the sick. This is what, according to him, led to a renunciation of the principle of care. “We waited for the situation to get worse”, summarizes the doctor who considers his first judgment as “policy”.
