The MoU states that Latvia is satisfied with this decision, because at the stage of consideration of legal acts and in the legal proceedings, Latvia united with other member states in opposing the elements of the package, which contradicted the principle of proportionality, free market and climate conditions.
In the view of the Ministry, the Mobility Package approved in 2020 creates a negative precedent as a whole and includes conditions that are not aimed at the development of the industry, but at limiting the activities of carriers in certain regions.
The requirements specified in the package generally do not contribute to the strengthening of the European Union (EU) single market, create a significant administrative burden, especially for small and medium-sized enterprises, and are not in line with the EU’s climate policy and may have a negative impact on road traffic safety, the ministry notes.
The MoU emphasizes that these rules not only unnecessarily burden the industry, but mainly “artificially” create additional empty trips. In addition, the rule to return to the country of registration has the greatest impact on countries that are geographically further from the center of the EU, and it takes longer to get from one point to another.
The MoU states that a number of EU Member States filed a claim in the case regarding several aspects of Mobility, such as the ban on drivers taking regular or compensatory weekly rest periods in the vehicle, the obligation of carriers to organize the work of their drivers in such a way that they return to the company’s operational center every four weeks, or at your place of residence and other requirements.
In the judgment, the court rejected the mentioned demands, except for the obligation to return the vehicle every eight weeks.
LETA already reported that from February 21, 2022, the EU Mobility Package provided that the cargo carrier must ensure that the vehicles at the disposal of the company, which are used in international transport, are returned to the country of registration of the company within at least eight weeks after leaving it.
