According to Muslim law, a girl who has reached puberty can get married even if she is not of age. The High Court pointed out that the marriage does not require the consent of the guardians and the husbands cannot be prosecuted under the POCSO Act.

The order of the Delhi High Court considered the petition of a Muslim couple who got married in Bihar despite the objection of the family. When the married girl became pregnant at the age of 15, the police filed a case against her husband on the complaint filed by the girl’s family and arrested the husband. After this, the girl approached the court.

The court heard the petition and clarified that according to Muslim law, a girl who is in her period can get married even if she is not of age. Also after marriage the girl has the right to live with her husband. The High Court also held that a case cannot be registered against the husband under the POCSO Act for post-marital sex. The order belongs to Justice Jasmeet Singh of the Delhi High Court.
