Accused of killing former Band cameraman goes to jury this Tuesday

A Justice of Rio de Janeiro denied the request of defendants Fábio Raposo Barbosa and Caio Silva de Souza and maintained the popular jury in the case of the death of Band TV cameraman, Santiago Andrade, for this Tuesday, 12th, at 1 pm.

Santiago died after being hit in the head by a firecracker during demonstrations in 2013, in the capital of Rio de Janeiro. He was working covering the protests for the broadcaster when he suffered the accident. Fábio and Caio are accused of committing the crime. They are charged with qualified homicide using explosives.

The penalty for the crime is 12 to 30 years in prison. Even after almost ten years, the accused were only imprisoned for a year and a month. They are currently under house arrest and wearing electronic ankle bracelets.

In an interview with Band, the victim’s daughter, Vanessa Andrade, said that, while the defendants are free, her family remains imprisoned in a crime that has not yet been judged.

The trial was scheduled to take place in 2019, but Caio’s defense filed a request for habeas corpuswhich suspended the session.

After the jury was scheduled for December this year, the defendants’ lawyers again asked for the trial to be postponed. Both are accused of homicide with eventual intent — when the risk of killing is assumed. For the defense, the charge should be manslaughter, when there is no intention to kill.

The judge did not accept the lawyers’ request and retained the jury. If he had accepted the change in classification, the crime would have been judged by a judge, and not by a jury made up of citizens. Furthermore, the penalty for manslaughter is lower, at a maximum of 3 years — not counting aggravating factors.
