Request for new special prosecution law from ruling and opposition parties

On the 24th, Acting President Han Deok-soo hinted at exercising the right to request a reconsideration (veto) of the Insurrection and First Lady Kim Kun-hee Special Prosecutor Act, saying, “We need to create a legal framework that both the investigating party and the receiving party can accept as fair.” They stated that these special prosecution laws cannot be promulgated unless the ruling and opposition parties reach an agreement and prepare a new special prosecution law that is not likely to be unconstitutional.
Acting President Han said at the Cabinet meeting that day, “In order to wisely handle pending issues where legal interpretations and political views conflict, such as the handling of the Special Prosecutor Act or the appointment of Constitutional Court judges, the ruling and opposition parties must come together more than anything else.” The Prime Minister’s Office is of the position that the Democratic Party of Korea is rushing to appoint even though legal issues, such as whether the acting president can appoint a Constitutional Court judge recommended by the National Assembly and whether it is appropriate to appoint a judge to hear the judgment in an impeachment prosecution situation, have not been resolved.
The fact that an acting authority said on this day, “We will appoint an ambassador for international financial cooperation through a cabinet meeting, and we plan to appoint an ambassador for international investment cooperation soon,” can be interpreted as an intention to restore external trust even by exercising the right to appoint and dismiss if necessary. Former Financial Services Commission Chairman Choi Jong-gu will be appointed as the new International Financial Cooperation Ambassador, and former American Chamber of Commerce in Korea Chairman Jeffrey Jones will be appointed as the International Investment Cooperation Ambassador.
Regarding the opposition party’s push to impeach Acting President Han, a senior official in the Prime Minister’s Office said, “If faith in the (Acting President Han) system is shaken and trust is lost, the international community’s trust in us will collapse,” adding, “That will ultimately affect our external credibility.” “It will appear, and it is bound to have a negative impact on our economy,” he warned. One government official expressed concern, “If impeachment continues, Korea will continue to send a signal that it is a politically unstable country.”
People Power Party floor leader Kwon Seong-dong also held a press conference at the National Assembly on this day and said, “The impeachment of Acting President Han is a diplomatic and security self-harm that undermines the ROK-US alliance and a declaration of the collapse of the government,” adding, “It is a gangster-like threat.” He criticized, “This is like confessing that the stabilization of state affairs that the Democratic Party has been crying out for was ultimately a hijacking of state affairs.” He continued, “In 1933, Hitler enacted the Enabling Act, allowing the executive branch to seize legislative power from the National Assembly, which was the signal for a full-fledged Nazi Germany system.” He continued, “Now, the Democratic Party is using the card of impeachment to destroy the executive branch, but the direction is only different. “It is the same in essence as the Enabling Act in that the separation is collapsed and the party leader wields all power,” he argued.
Some point out that if Deputy Prime Minister and Minister of Strategy and Finance Choi Sang-mok takes over as acting authority, the controversy over legitimacy may intensify if the Deputy Prime Minister, who was not appointed with the consent of the National Assembly, exercises authority such as appointing a Constitutional Court judge.
