The Council of Ministers met yesterday Thursday, April 27, 2023, in the usual room for deliberations, under the chairmanship of His Excellency, Mr. MOHAMED BAZOUM, President of the Republic, President of the Council of Ministers. After reviewing the items on its agenda, the Board took the following decisions:
I. IN THE TITLE OF THE MINISTRY OF THE INTERIOR AND DECENTRALIZATION.
The Council of Ministers examined and adopted the draft texts below:
1.1. Bill extending the state of emergency in the Filingué department (Tillabéri region).
This bill is taken to extend the state of emergency in the department of Filingué for a new period of three (03) months, from April 27 to July 25, 2023 inclusive.
1.2. Bill extending the state of emergency in the Diffa region and in certain departments of the regions of Tahoua (departments of Tassara and Tillia) and Tillabéri (departments of Ouallam, Ayerou, Bankilaré, Abala, Banibangou, Say, Torodi, Téra, Tillabéri and Gothèye).
This Bill is enacted to extend the state of emergency in these areas for a further period of three (3) months, from 1is May to July 29, 2023 inclusive. These two bills will be transmitted to the National Assembly.
Moreover, after assessing the security situation in the departments of Ballayara and Kollo (Tillabéri region), the Government decided not to extend the state of emergency in these localities.
II. IN THE TITLE OF THE MINISTRY OF MINES.
The Council of Ministers examined and adopted the draft texts below:
2.1. Draft law amending and supplementing law n° 2022-033 of July 05, 2022, on the mining law.
Law No. 2022-033 of July 5, 2022, on the mining law has certain contradictions and shortcomings.
These are mainly articles 285 and 286 of the mining law which refer the setting of the base and the methods of recovery of the rates of the costs of instruction, the fixed rights and the surface royalty to the decree of application and this , in contradiction with the provisions of article 99 of the Constitution which specifies that the base, the rate and the methods of collection of the impositions of any nature are fixed by the law.
This draft law is initiated to comply with the provisions of the fundamental law and to harmonize certain provisions of the mining law with those of Regulation No. 18/2003/CM/UEMOA of December 23, 2003, on the WAEMU Community Mining Code. . This bill will be transmitted to the National Assembly.
2.2. Draft decree establishing a Public Establishment of a Scientific, Cultural and Technical nature called the “Geological and Mining Research Center” abbreviated as CRGM.
2.3. Draft decree approving the statutes of the Geological and Mining Research Center (CRGM).
The purpose of these two draft decrees is to bring the texts establishing, organizing and operating the Geological and Mining Research Center (CRGM) into compliance with the provisions of Law No. 2020-020bis of June 03, 2020, setting the rules for the creation categories of public establishments and its implementing decree.
It should be noted that the adoption of this draft decree was used to transform the CRGM, which was until then a public institution of an administrative nature, into a public institution of a scientific, cultural and technical nature, due to of his new assignments.
III. IN THE TITLE OF THE MINISTRY OF NATIONAL DEFENCE.
The Council of Ministers examined and adopted the Draft decree amending decree n° 2022-588/PRN/MDN of July 21, 2022, on the organization of the Ministry of National Defence.
This draft decree enshrines the splitting of the Directorate of Legal, Judicial Affairs and Litigation into two Directorates, namely the Directorate of Judicial Affairs and Litigation and the Directorate of Legislation. This reorganization will make it possible to ensure better monitoring of the Conventions and Agreements signed with the various partners.
IV. IN THE TITLE OF THE MINISTRY OF AGRICULTURE.
The Council of Ministers examined and adopted the draft decree modifying and supplementing decree n° 97-008/PRN/MAG/EL of January 10, 1997, on the organization, attributions and functioning of the institutions responsible for the application of the principles of Orientation of the Rural Code.
Niger has embarked on a process of efficient and rational management of natural resources while guaranteeing maximum security to rural operators through the adoption of Ordinance No. 93-015 of March 2, 1993, establishing the principles of Orientation of the Rural Code.
Regulatory texts have been adopted, including Decree No. 97-008/PRN/MAG/EL of January 10, 1997, which enshrines the creation of institutions responsible for implementing the guiding principles of the Rural Code and land management tools. for the promotion of rural activities (agricultural, forestry and pastoral). Among the management tools provided for by the aforementioned decree, there is the creation of a documentation center and a database on rural land, which is a computerized tool for land management.
The purpose of this draft decree is thus, on the one hand, to allow the Permanent Secretariat of the Rural Code (SPCR) to set up, manage and administer a Center for Documentation and Information System on Rural Land and, on the other hand, to create a service in charge of the management and administration of the Center for Documentation and Information System on Rural Land within the Permanent Secretariat of the Rural Code (SPCR).
V. PERSONAL MEASURES.
The Council of Ministers has adopted the following individual measures:
5.1. Under THE MINISTRY OF PUBLIC HEALTH, POPULATION AND SOCIAL AFFAIRS.
• Mr. Mahamadoul Kafi Djibrilla, doctor of nursing, Mle 72337/S, is appointed service inspector, replacing Mr. Habou Salamou called to other duties.
· Mr. Aboubacar Oumarou, state-certified doctor, Mle 132053/U, has been appointed general manager of the ENSP of Tahoua.
· Mr. Salifou Abdramane, retired doctor of nursing, is appointed chairman of the board of directors of the ENSP of Tahoua.
· Mrs. Mahaman Nana Abagana, senior technician in obstetrical care, Mle 51922/S, is appointed Deputy Director General of Issaka Gazoby Maternity Hospital.
5.2. Under THE MINISTRY OF ENERGY AND RENEWABLE ENERGIES.
· Mr. Madougou Boubacar, engineer in industrial engineering, is appointed Chairman of the Board of Directors of the National Agency for Solar Energy (ANERSOL).
5.3. Under THE MINISTRY FOR THE PROMOTION OF WOMEN AND THE PROTECTION OF CHILDREN.
· Mrs. Abdoul Nasser MEMUNA Issa Issaka, documentalist, Mle 85210/Y, is appointed director of archives, information, documentation and public relations.
5.4. Under THE MINISTRY OF THE INTERIOR AND DECENTRALIZATION.
Pursuant to the provisions of Article 63 of Ordinance No. 2010-54 of September 17, 2010, on the general code of local authorities of the Republic of Niger, are dismissed from their functions for serious misconduct:
– Mr. Ramadan Charou, Mayor of the rural Commune of Fachi;
– Mr. Ali Chama Hamidine, Mayor of the Rural Commune of Doguéraoua.
5.5. Under THE MINISTRY OF FINANCE.
· Mr. Barkay Molimi, Chief Customs Inspector, Mle 69261/F, has been appointed Director General of Customs, replacing Mr. Abdallah Harouna, called to other duties.
· Mr. Abdallah Harouna, Chief Customs Inspector, Mle 66249/J, is appointed Inspector General of Finance.
· Mr. N’Diaye Demba Assane, is appointed President of the National Commission for the Regulation of Microfinance.
VI. COMMUNICATIONS.
The Council of Ministers heard several communications:
A communication from the Minister of State, Minister of Foreign Affairs and Cooperation on the situation of Nigeriens in Sudan.
The security situation in Sudan remains worrying. The Government has decided to repatriate our compatriots living in this country. To date, 42 Nigeriens including diplomats, trainees and students have been repatriated. The repatriation operation of other Nigeriens, including 44 students, is continuing.
A communication from the Minister of Agriculture relating to the Japanese donation for the benefit of ONAHA.
The Japanese Government has just made a donation to the State worth six billion (6,000,000,000) CFA francs intended to acquire machinery and equipment through the financing of a project whose objective is to ” strengthen the capacities of ONAHA for the promotion of irrigated rice growing”. This donation consists of:
– 55 earthmoving machines including 6 hydraulic shovels, 4 bulldozers, 4 compactors, 2 graders, 2 loaders, 6 agricultural tractors, 20 trucks including 12 skips;
– 57 machine tools and maintenance equipment;
– one (1) set of spare parts.
In addition to this donation of equipment and machinery, the donation includes a training component for ONAHA technicians. This donation will enable ONAHA to have two complete brigades, ie an intervention capacity on four (4) additional medium-sized sites.
Three (03) communications from the Minister of Public Health, Population and Social Affairs:
the first communication relates to the awarding of a public contract for the acquisition of hemodialysis consumables for the benefit of the Nephrology department of the Amirou Boubacar Diallo National Hospital.
This contract, for an amount of seven hundred and ninety million eight fifty-four thousand seven hundred (790,854,700) FCFA excluding taxes, has as provisional winner the company NIPRO MEDICAL EUROPE NV established at Weihoek 3H, 1930 Zaventem ( Belgium), for a delivery period of five (05) months.
the second communication relates to the award of a public contract awarded by open invitation to tender for the supply and installation of office furniture for the benefit of the Ministry of Public Health, Population and Social Affairs.
This contract, in the amount of four hundred and five million nine hundred and twenty-eight thousand two hundred and sixty-six (405,928,266) CFA francs, all taxes included, has as provisional winner the African Society for International Trade (SACI SARL) , domiciled in Niamey BP: 2075 Niamey, for a delivery period of two (02) months, from the date of approval.
the third communication relates to the award of a public contract awarded by open invitation to tender for the supply and installation of office equipment.
This contract, in the amount of four hundred and thirteen million five hundred four thousand five hundred and sixty-nine (413,504,569) CFA francs, all taxes included, has as provisional winner the Nigerien company of Equipment and Logistics (SNEL SARL) domiciled in Niamey, for a delivery period of forty-five (45) days, from the date of approval.
These last three (03) communications are made for information purposes, in accordance with the provisions of Order No. 018/PM/ARCOP of January 18, 2023, setting the thresholds in the context of public procurement which provides in its article 13 that: “Any public purchase whose amount is equal to or greater than three hundred million (300,000,000) CFA francs excluding value added tax must be the subject of a prior communication to the Council of Ministers on the part of of the Minister in charge of the sector concerned”.
The agenda being exhausted, His Excellency the President of the Republic closed the meeting.
