The AfD had filed a lawsuit over three passages in the Thuringian report on the protection of the constitution. Now the Weimar Administrative Court has ruled and rejected the allegations.
The publication of three passages of text about the Thuringian AfD in the 2021 state constitutional protection report was legal, according to a court. The Weimar Administrative Court ruled that the parts of the text did not need to be deleted, as the party had demanded, nor publicly corrected. The AfD’s lawsuit was dismissed.
The case did not concern the general classification of the AfD as “certainly right-wing extremist” in the report. The verdict is not yet legally binding.
The AfD had taken action against three passages in the report in which posts by the two state spokespersons Björn Höcke and Stefan Möller were, in their view, distorted and abbreviated. In the report, they were entitled “Islamophobia: Violations of human dignity”, “Attacks on the rule of law” and “Historical revisionism”.
The Thuringian Office for the Protection of the Constitution argued in the oral hearing that a classification requires evidence that provides an overall picture. A direction of attack had become apparent.
