AFP: 50-year-old affiliates may request withdrawal of funds

RETIREMENT AT 50 YEARS IS NOW POSSIBLE BY NEW LAW

AFP: The regulation specifies that early retirement grants the recognition bonus two years after the process begins

According to Ley 31332which was published in September 2021, the affiliates to the Pension Administrators (AFP) that have 50 years of age and have been unemployed for at least 12 monthsmay request the withdrawal of their funds under the modality of early retirement.

This regime allows male and female contributing workers of the Private Pension System (SPP) advance your retirement as long as they comply with the following established:

FOR UNEMPLOYMENT:

• At the time of starting the process, you must be at least 50 years of age.
• Be at least 12 months unemployed
• Submit an affidavit configuring the unemployment condition for a period of not less than 12 months prior to the application.

BY ORDINARY MODALITY:

• At the time of starting the process, you must be at least 50 years of age.
• Have a pension calculated in the SPP that must be greater than or equal to 40% of the average remuneration received and income declared during the last 120 monthsThat is, in the last 10 years.
• Voluntary contributions for pension purposes or without pension purposes that exceed 20% of the individual capitalization account of mandatory contributions with a permanence of less than nine months in the individual capitalization account (CIC) are not considered.

RECOGNITION BONUS

It should be noted that, The regulation specifies that early retirement provides the right to redemption of the recognition bond two years after the start of the process, or when you reach 65 years of age..

“Even when the affiliate’s CIC funds have previously been exhausted and after information from the AFP of the affiliates qualified to access this regime,” the document indicates.

When processing early retirement, the affiliate can request the following modalities:

• access a pension
• Withdraw 95.5% of the fund
• Withdraw part of the fund and have access to a retirement with the remaining balance
