Without properly organizing the documents, Águas Guariroba will have to resubmit to Agereg (Campo Grande Delegated Public Services Regulation Agency) the data confirming that the concessionaire did not disrespect the municipal decree regarding notifications in user registrations.

In a note, the agency informed that “the documents sent by Águas Guariroba were not clear about the right to broad consumer protection, therefore, we determined that clearer information be forwarded, which leaves no doubt that all consumer rights have been respected before being fined”.

In this vein, the decision of the CEO of Agereg, Odilon de Oliveira Júnior, published in the Official Gazette this week, reveals the problem and mentions that the concessionaire “limited itself to sending the documentation without any organization, the documents were delivered out of order ”.

The publication also points out that three volumes were sent, one with terms of occurrences; another volume with some acknowledgments sent to users; and another volume containing e-mail reading receipts. “The way the documents were sent made it impossible for the Regulatory Body to assess compliance with the requirements of article 66 of Decree n. 14,142/2020”.

This decree defines that when an irregularity is found in the license plates by the concessionaire, it must try to notify the user at home three times and only after that, publish a public notice. In addition, the notice must be published in a local newspaper with wide circulation.

The documents were requested to prove whether Águas followed the steps set out in the decree before fining customers. Thus, since May 15, the fines applied by the concessionaire, totaling 600, have been suspended and will remain so until Agereg proves whether there was regularity in the application of notifications.

The agency gave ten days to the Águas Guariroba concessionaire “to correct the flaw pointed out, removing the documents filed with the AG Letter n. 127/2023, replacing them with documents duly organized by user name, in order to demonstrate compliance with the article 66 of Decree 14.142/2020”.

In contact with Águas Guariroba, the advisory informed that the legal sector will be activated to respond to the demand.
