Baquero’s request postpones the progress of the case, extending the process for at least one more week, and with the possibility that the delay could extend up to two weeks.

Magistrate Altus Baquero, member of the National Electoral Council – CNE, requested the rotation of the file related to Gustavo Petro’s presidential campaign, in the midst of an investigation into alleged irregularities in the spending limits of the 2022 campaign. The magistrate’s request , who was recently reinstated to his position after a period of absence, will delay a decision on the case for at least two more weeks.

Baquero affirmed that he needs additional time to review the file due to the time he was away from the CNE and stated that a detailed analysis is required before making a decision in the process that involves both President Petro and Ricardo Roa, manager of the Petro Presidente campaign. .

The case, which was scheduled to be discussed by the full chamber of the electoral court on Monday, September 30, is based on the presentation of judges Benjamín Ortiz and Álvaro Hernán Prada, who suggest opening a formal investigation against Gustavo Petro’s campaign for a possible violation of spending caps in the 2022 election race. Baquero’s request postpones the progress of the case, extending the process for at least one more week, and with the possibility that the delay could last up to two weeks.

Guardianship before the Superior Court of Bogotá

At the same time, the Superior Court of Bogotá admitted a protection filed by Heráclito Landinez, representative to the Chamber for the Historical Pact. In his request, Landinez argues that the investigation into President Petro should be carried out exclusively by the Accusations Commission of the House of Representatives, and not by the CNE, considering that the latter does not have the constitutional competence to investigate a head of State.

Landinez pointed out that the protection seeks to protect the fundamental rights of more than 11 million Colombians who voted for Petro in the 2022 elections, and affirmed that the presidential figure and democracy are at risk due to the actions of the CNE. This position coincides with the opinion of President Petro himself, who has publicly expressed that the investigation against him is part of what he considers an attempted coup d’état.

The development of this research has generated an intense political debate, with implications both in the electoral sphere and in the democratic stability of the country. While the CNE evaluates whether or not to advance in the formulation of charges, the course of the process could be impacted by the decision of the guardianship admitted in Bogotá.
