Amiram Ben Oliel, who was convicted of murdering the Devabsha family in Duma, filed a lawsuit against the Shin Bet in the sum of over five million shekels on Sunday this week through attorney Menashe Yado from the Honnu organization. The lawsuit was filed by Ben Oliel demanding that he be compensated for the torture he underwent during his investigation and the mental damage he suffered as a result of it.
In the statement of claim, Attorney Yado describes the torture that Ben Oliel went through in the Shin Bet’s attempt to extract from him a confession about the arson in Douma. Yado points out that until an explicit decision is made to allow the publication, the severe physical torture methods the plaintiff underwent will not be published, but at this stage it is already possible to publish the severe injuries in the period preceding the torture: “The plaintiff was humiliated, handcuffed for a long time without legal justification, cold showers, a winter night without jacket, harming religious sentiments by the deliberate and prolonged playing of women’s singing, a woman’s deliberate touching of the plaintiff’s body, voiced threats, violence and voiced threats severe profanity. The torture caused great harm to the plaintiff, his body, his feelings, his right to his body, his autonomy, his right to remain silent during the investigation , thanks to him choosing and shaping without violence the course of his life”, described Yado.
Yado adds and details in the statement of claim the damages caused to Ben Oliel as a result of the torture: “As a result of the torture, the plaintiff was forced to give an incriminating version, in which the plaintiff has confessed to this day, on the strength of which alone the plaintiff was sentenced to prolonged life imprisonment, and he suffered actual mental harm from which the plaintiff suffers to this day,” he added Yado
Attorney Yado stated after the filing of the lawsuit: “The decision to interrogate Amiram with physical torture blatantly breached the boundaries of protection that the law has established for those interrogated, and this lawsuit comes to do corrective justice in this aspect with Amiram, and in the process put in place the prohibitions against torturing interrogators Shin Bet.
