The Specialized Chamber of the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF) determined that the president Andres Manuel Lopez Obrador violated the principles of impartiality, neutrality and equity in the contest; misused public resources and social programs, coerced the vote of citizens, carried out personalized promotion and disseminated government propaganda during the prohibited period.
The above, derived from the statements issued in the “morning press conferences” held on May 9 and 11, 2023, in which he referred to Plan C and the need to achieve a qualified majority in the chambers of the Congress of the Union to continue the transformation.

The Plenary considered that López Obrador’s words had an electoral impact, since they were calls to vote in favor of one political option and against another, with which he intended to influence the preferences of the citizens.
The then head of the Mexico City Government, Claudia Sheinbaum, was also held responsible for violating constitutional principles for making statements related to the president’s comments at a press conference.
Also held responsible for this same conduct were Jesús Ramírez Cuevas, coordinator of Social Communication and spokesman for the Presidency of the Republic; Sigfrido Barjau de la Rosa, head of the Center for the Production of Informative and Special Programs (Cepropie); Jenaro Villamil, then president of the Public Broadcasting System of the Mexican State (SPR); Jessica Ramírez, general director of Digital Communication; and Pedro Daniel Ramírez Pérez, head of a department attached to the aforementioned Coordination.
These officials also misused public resources, because they are responsible for the transmission and dissemination of the “Mañaneras” and used human and material resources for this.

The coordinator of Social Communication and the head of CEPROPIE also engaged in disseminating government propaganda during a prohibited period.
Morena, PT and PVEM did not obtain an undue benefit from these conducts, since it was not proven that they had knowledge of the reported conducts and failed to take action to stop their effects.
The President, the Specialized Chamber recalled, cannot be sanctioned for electoral violations; his responsibility is only declared, in accordance with criteria issued by the Superior Chamber of this court.
In the case of Sheinbaum Pardo, the Congress of Mexico City was notified to determine what is legally appropriate; in the case of Villamil Rodríguez, the Internal Control Body of the SPR was notified; and in the case of the rest of the public servants, the Internal Control Body of the Presidency of the Republic was notified.
