Leaders of the Chamber of Deputies reached an agreement this Tuesday (5) in relation to the final text of the PEC (Proposed Constitutional Amendment) of Amnesty. This project proposes forgiveness of fines imposed on political parties for non-compliance with the minimum quota of public funds for candidates and black people.

The report prepared by deputy Antonio Carlos Rodrigues contemplates the inclusion in the Constitution of the obligation that parties distribute at least 20% of the electoral fund to black and brown candidates, which results in the reduction of resources available to these groups.

In addition, the text provides for amnesty for parties that have not distributed funds to black candidates and those that have not applied the proportion of the fund above 30% for female candidates, even when there were a greater number of candidates than required by that percentage. .

With regard to the application of penalties and forgiveness, the PEC establishes that only 10% of the Party Fund may be blocked by the Justice. This will occur if the punishment is aimed at parties that did not submit a minimum of 30% of women candidates, and amnesty will be granted if the court decision results in the removal of women’s mandates.

The PEC, which had already been approved by the Constitution and Justice Commission (CCJ) of the Chamber in a previous version, is currently following its procedure in a special commission. The proposal is authored by deputy Paulo Magalhães and has broad support from several parties in the Chamber, including leaders of both the government and the opposition.

The main objective of this PEC is to establish an initial milestone for the implementation of the new guidelines provided for in a 2022 constitutional amendment.

Most political parties did not comply with the rules stipulated for the distribution of electoral fund resources intended for candidates of women and black people in the year 2022.
